Terms of Service
Effective Date: 21 March 2026
These Terms of Service ("Terms") govern your use of the services provided by Headline MA Pty Ltd (ABN 94 516 468 127), trading as Headline Marketing Agency ("Headline", "we", "us", "our"). By engaging our services, you agree to these Terms.
1. Service Scope
Headline provides Amazon advertising management services including, but not limited to: Amazon PPC campaign management (Sponsored Products, Sponsored Brands, Sponsored Display), Amazon DSP programmatic advertising, Amazon Marketing Cloud (AMC) analytics, campaign strategy and consulting, and performance reporting through our proprietary analytics platform.
Services are provided solely on behalf of authorized clients for the management and optimization of their Amazon advertising accounts.
2. Client Authorization & Data Access
To deliver our services, clients must authorize Headline to access their Amazon advertising and seller accounts through Amazon’s official mechanisms (Amazon Seller Central, Amazon Advertising console, Amazon Selling Partner API, and Amazon Advertising API).
By granting API access, the client confirms they are the authorized account holder or have obtained proper authorization from the account holder. Headline will only access data that is necessary for the delivery of agreed-upon services.
Clients may revoke API access at any time through their Amazon account settings. Upon revocation, Headline will cease data processing within 24 hours and delete stored data within 90 days, unless retention is required by law.
3. Data Handling & Security
Headline processes client data in compliance with Amazon’s Data Protection Policy (DPP) and Acceptable Use Policy (AUP). All data is processed and stored on Google Cloud Platform (GCP) infrastructure with the following security measures:
• Encryption at rest (AES-256) and in transit (TLS 1.2+) • Role-based access controls with audit logging • Regular security assessments and vulnerability management • Secure cloud infrastructure with automatic backups • Incident response procedures with defined escalation paths
We do not sell, rent, or share client data with third parties except as necessary to deliver the agreed services or as required by law. Our full data handling practices are described in our Privacy Policy.
4. Data Retention
Campaign and performance data is retained for the duration of the service agreement plus 2 years for reporting continuity and contractual obligation fulfillment. After contract termination, non-essential data is deleted within 90 days. Financial records are retained for 7 years in compliance with Australian tax law. Clients may request earlier deletion of non-essential data at any time by contacting hello@headlinema.com.
5. Service Agreements & Fees
Service engagements require a minimum initial commitment of 3 months, after which the engagement continues on a month-to-month basis. Management fees are based on the scope of services, number of ASINs, marketplace coverage, and advertising complexity. Specific fee structures are outlined in individual client agreements.
Either party may terminate the agreement with 30 days written notice after the initial commitment period.
6. Intellectual Property
All proprietary tools, analytics platforms, methodologies, and processes developed by Headline remain the intellectual property of Headline MA Pty Ltd. Clients retain full ownership of their Amazon accounts, product listings, and advertising assets.
7. Limitation of Liability
Headline provides advertising management services on a best-efforts basis. While we strive to achieve agreed-upon performance targets, we do not guarantee specific advertising outcomes, as results are influenced by market conditions, competitor activity, Amazon algorithm changes, and other factors beyond our control.
To the maximum extent permitted by law, Headline’s total liability for any claim arising from services shall not exceed the fees paid by the client in the 3 months preceding the claim.
8. Confidentiality
Both parties agree to maintain the confidentiality of proprietary and business-sensitive information exchanged during the engagement. This obligation survives the termination of the service agreement.
9. Amazon Compliance
Headline operates in compliance with Amazon’s Terms of Service, Advertising Policies, Data Protection Policy, and Acceptable Use Policy. We are an Amazon Ads Verified Partner and adhere to all applicable Amazon program requirements.

10. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
